Terms & Conditions: Engage Wellness Acton, MA

These Terms and Conditions govern your use of the Engage Wellness website. Please read them carefully before using the Site.

Last updated: October 30, 2026

Please Read These Terms Carefully Before Using This Site

This website is operated by Engage Wellness Acton, MA (“Engage Wellness,” “we,” “us,” or “our”), a drug and alcohol addiction and dual diagnosis treatment provider located at 164 Great Rd, Acton, MA 01720. By accessing or using https://engagewellnessnow.com/ (the “Site”), you agree to be bound by these Terms and Conditions (the “Terms”).

Our Privacy Policy, our Editorial Policy, and any other rules, policies, or supplemental terms we post on the Site from time to time are incorporated into these Terms by reference. Together, they form the “Agreement” between you and Engage Wellness. If you do not accept the Agreement in full, you are not permitted to use the Site.

IMPORTANT: THESE TERMS INCLUDE A BINDING INDIVIDUAL ARBITRATION PROVISION AND CLASS ACTION WAIVER IN SECTION 13 THAT AFFECT HOW DISPUTES BETWEEN YOU AND ENGAGE WELLNESS ARE RESOLVED.

1. No Medical Advice; Emergencies

Everything on this Site, including articles, blog posts, detox and substance guides, Massachusetts treatment guides, graphics, and other materials (the “Content”), is provided for general educational and informational purposes only. The Content is not medical, psychiatric, psychological, or clinical advice, and it is not a substitute for diagnosis or treatment by a qualified health care professional.

Always consult a physician or other licensed provider with questions about a medical or mental health condition, substance use, withdrawal, or medication. Never ignore professional advice or delay seeking it because of something you read on this Site. Withdrawal from alcohol, benzodiazepines, opioids, and certain other substances can be medically dangerous and should only be managed under medical supervision. Detox information on the Site is educational and is not a set of instructions for detoxing on your own.

If you are experiencing a medical emergency, call 911 or go to the nearest emergency room. If you are in crisis or having thoughts of suicide, call or text 988 to reach the 988 Suicide & Crisis Lifeline. Any reliance you place on Content provided by us, our staff, contributors, or other visitors is strictly at your own risk.

2. No Provider–Patient Relationship

Using the Site, submitting a contact form, verifying insurance, chatting online, or calling our admissions line does not create a provider–patient or therapist–client relationship between you and Engage Wellness or any of our clinicians or medical providers. A treatment relationship begins only after you complete our admissions and clinical assessment process and are formally accepted into one of our programs. Treatment services are governed by separate consent, financial, and program agreements, which control over these Terms in the event of any conflict.

3. Eligibility

The Site is intended for use by individuals who are at least eighteen (18) years old and legally able to enter into binding contracts. If you are under 18, you may use the Site only with the involvement and permission of a parent or legal guardian. A parent or guardian who seeks information on behalf of a minor accepts these Terms on the minor’s behalf.

4. Acceptance of the Agreement and Changes to These Terms

The Agreement is the entire agreement between you and us regarding your use of the Site and replaces any prior agreements, representations, or understandings about the Site. We may revise these Terms at any time, at our sole discretion, by posting an updated version on this page and changing the “Last updated” date above.

Your continued use of the Site after changes are posted means you accept the revised Terms. However, changes to the arbitration, class action waiver, or other dispute resolution provisions in Section 13 (the “Dispute Resolution Provisions”) will not apply to any dispute that arose before the change was posted. Those disputes remain governed by the Dispute Resolution Provisions in effect when the dispute arose. We encourage you to review this page regularly.

5. Your Representations

By using the Site, you represent that: (a) any information you submit, including through contact, admissions, or insurance verification forms, is truthful, accurate, and your own (or that you are authorized to submit it on behalf of another person); (b) you will keep your contact information current so we can reach you; (c) your use of the Site does not violate any applicable law or regulation; (d) you meet the eligibility requirements in Section 3; and (e) you will follow the rules of conduct in Section 6.

6. Acceptable Use of the Site

The Site provides information about substance use disorders, detox, dual diagnosis and mental health conditions, levels of care, therapies, insurance, and recovery resources in Massachusetts. When you use the Site, you agree that you will not:

  • Use the Site for any unlawful, fraudulent, or unauthorized purpose.
  • Harvest or collect names, email addresses, phone numbers, or other information about visitors, staff, or contributors, including to send unsolicited communications.
  • Frame, mirror, or deep-link to the Site in a way that suggests an affiliation with or endorsement by Engage Wellness without our prior written consent.
  • Upload, install, or distribute viruses, spyware, malware, or any other code designed to monitor, damage, or interfere with the Site or any device or network.
  • Attempt to gain unauthorized access to the Site, its servers, or connected systems, or interfere with or place an unreasonable load on the Site.
  • Use bots, scrapers, crawlers, or other automated means to access or copy the Site or its Content, except for standard search engine indexing.
  • Impersonate any person, including an Engage Wellness employee, or misrepresent your affiliation with any person or organization.
  • Submit false admissions or insurance inquiries, or use the Site to engage in patient brokering or any other prohibited referral practice.

Some Content discusses addiction, trauma, suicidal ideation, and mental health in frank terms that some readers may find distressing. Content may also become outdated or contain inaccuracies despite our editorial review.

When you submit your phone number or email address through the Site, you consent to receive calls, text messages, and emails from Engage Wellness about your inquiry, admissions, and insurance verification, including calls or texts made with automated technology. Message and data rates may apply. You can opt out of text messages at any time by replying STOP, and you can ask us to stop contacting you by calling (978) 699-9786 or emailing [email protected]. Consent to receive communications is not a condition of receiving treatment.

The personal information you provide is handled as described in our Privacy Policy. Please note that standard email and website forms may not be fully secure. Avoid sending detailed medical or treatment information through the Site; our admissions team will collect what is needed through a confidential process.

You agree that agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement that such communications be in writing.

8. User Submissions, Reviews, and Testimonials

The Site may now or in the future allow you to post or send content, such as blog comments, reviews, testimonials, questions, photos, videos, or ideas (“Submissions”). Any area where Submissions are visible to others is a “Public Area.” You agree that:

  • Public Areas are not confidential. Do not post your own or anyone else’s health, treatment, or recovery details, full name, phone number, address, or other identifying information in a Public Area. Information shared publicly may be seen by anyone.
  • You own or have permission to share what you submit. You will only submit content you created or have all necessary rights to share, and that does not infringe anyone’s copyright, trademark, privacy, publicity, or other rights. You will not post photos or videos of other people without their explicit permission.
  • Prohibited content. You will not submit content that is unlawful, hateful, harassing, threatening, obscene, sexually explicit, defamatory, or that promotes substance use, self-harm, or illegal activity, or that contains malicious code.
  • License to us. By making a Submission, you grant Engage Wellness a royalty-free, perpetual, irrevocable, worldwide, non-exclusive license, with the right to sublicense, to use, reproduce, modify, adapt, publish, translate, distribute, display, and create derivative works from that Submission in any media now known or later developed. You confirm that every person who appears in your Submission has authorized this use.
  • Ideas are non-confidential. Business ideas, suggestions, or proposals you send us by any means are non-confidential, and we may use them without obligation to you. If you want to keep an idea private, please do not send it to us.
  • Our discretion. We may review, edit, decline, or remove any Submission at any time, for any reason, without notice.

Any testimonials, reviews, or ratings shown on the Site reflect individual experiences and are not a guarantee that any other person will achieve similar results. Recovery outcomes vary from person to person. You agree to indemnify and hold Engage Wellness harmless from any claim arising out of your Submissions or your breach of this Section.

9. Our Intellectual Property

The Site and its Content, including text, articles, guides, graphics, photographs, logos, the Engage Wellness name, and other trademarks and service marks (“Marks”), are owned by or licensed to Engage Wellness and are protected by United States and international copyright, trademark, and other intellectual property laws. All rights not expressly granted to you are reserved.

You may view and print Content for your personal, non-commercial use only, provided you do not remove any copyright or proprietary notices. You may not otherwise copy, reproduce, republish, sell, or distribute any Content or Marks without our prior written permission. You agree not to circumvent, disable, or interfere with any security or access features of the Site, and not to access the Site except through the interface we provide. If you violate these Terms, your permission to use the Content ends automatically and you must destroy any copies you have made.

References on the Site to third-party publications, media outlets, accrediting bodies, or insurance carriers are for identification and informational purposes only. Their names and logos belong to their respective owners, and their appearance does not imply that those parties endorse Engage Wellness or any Content.

10. Our Management of the Site

  • Monitoring. We may, but are not required to, monitor the Site for violations of the Agreement, report suspected unlawful activity to law enforcement, take legal action against anyone who violates the Agreement, and manage the Site to protect our rights and the rights of others.
  • Termination of access. We may deny or suspend anyone’s access to the Site at any time, in our sole discretion and without notice or liability, including for a breach of the Agreement or applicable law.
  • Changes to the Site. We may modify, suspend, or discontinue all or any part of the Site, temporarily or permanently, at any time without notice or liability.
  • Risk of relying on information. Health information changes, and Content may be incomplete or out of date. Any use you make of the Content is at your own risk. If you have concerns about your health or anything you read on the Site, consult a physician or other qualified professional.

11. Programs, Insurance Verification, and Payment

The Site describes our levels of care, including our Day Treatment Program (PHP), Intensive Outpatient Program (IOP), Outpatient Program, Veterans Recovery Track, Family Program, Medication-Assisted Treatment (MAT), relapse prevention, and detox placement, as well as the therapies we offer. Program descriptions, schedules, and session frequency are general and may change without notice. Not every program or therapy is appropriate for every person, and the level of care recommended for you will be determined only through a clinical assessment.

Insurance verification through the Site is a courtesy estimate based on information provided by you and your insurer. It is not a guarantee of coverage, benefits, authorization, or payment, and it does not determine your final financial responsibility. Coverage decisions are made by your insurance carrier. Information about cash pay, financial assistance, or payment plans is general, and any actual financial arrangement is governed by a separate written agreement.

Where detox is needed, Engage Wellness may help coordinate placement with an independent third-party provider. Unless we tell you otherwise in writing, those providers are not operated by Engage Wellness, and we are not responsible for the services they deliver.

The Site may include links to third-party websites, research sources, media coverage, Massachusetts local resources, support groups, community organizations, or other providers. We provide these links for convenience only. We do not control, endorse, or take responsibility for any third-party website, product, service, provider, treatment, or content, including its accuracy, policies, or practices. Your use of any third-party site or service is at your own risk and subject to that third party’s terms.

You are solely responsible for your interactions with any third-party provider, facility, or organization you learn about through the Site. You agree that Engage Wellness is not liable for any dispute, harm, or loss, whether medical, financial, or otherwise, arising from those interactions, and you agree to hold us harmless from any such claims.

13. Arbitration Agreement and Class Action Waiver

Agreement to arbitrate. Except as provided below, you and Engage Wellness agree to resolve any dispute or claim arising out of or relating to the Site, the Content, the Agreement, any marketing or communications sent by or for us, or any other aspect of your relationship with us through the Site, through final and binding individual arbitration rather than in court. This applies to claims based in contract, tort, statute, fraud, misrepresentation, or any other legal theory, and to claims that arise after the Agreement ends. This provision should be interpreted as broadly as the law allows. It does not apply to disputes about clinical treatment services, which are governed by your separate treatment agreements.

Class action and jury trial waiver. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND ENGAGE WELLNESS EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO BRING OR PARTICIPATE IN ANY CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU MAY BRING CLAIMS AGAINST ENGAGE WELLNESS ONLY IN YOUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Exceptions. Either party may bring an individual claim in small claims court if it qualifies. Disputes over the validity or infringement of either party’s intellectual property rights are excluded from arbitration, and we may seek injunctive or other equitable relief in court to protect our intellectual property or proprietary rights.

Arbitration procedures. The arbitrator is bound by the Agreement. The arbitrator decides all issues except questions about the scope or enforceability of this arbitration provision, which a court will decide. The arbitrator will issue a reasoned written decision explaining the essential findings and conclusions. Unless both parties agree otherwise, the arbitrator may not consolidate more than one person’s claims or preside over any class or representative proceeding. An award applies only to the specific case and may not be used in any other case except to enforce the award. Each party is responsible for its share of arbitration fees, except as otherwise required by applicable law or the rules of the arbitration provider.

One-year time limit. ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THE AGREEMENT MUST BE FILED WITHIN ONE (1) YEAR AFTER THE EVENT OR FACTS GIVING RISE TO IT, OR THE CLAIM IS PERMANENTLY WAIVED, TO THE EXTENT PERMITTED BY LAW.

Survival. This Section survives termination of the Agreement.

14. Governing Law and Venue

The Agreement, and all questions about its construction, validity, enforcement, and the rights and obligations of the parties, are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of law rules, and by the Federal Arbitration Act where applicable. To the extent any matter is permitted to proceed in court, you consent to the exclusive jurisdiction and venue of the state and federal courts located in Middlesex County, Massachusetts, and each party waives any right to a jury trial in that action. Nothing in these Terms limits any rights you have that cannot be waived under applicable law.

15. Disclaimers

THE SITE AND ALL CONTENT AND INFORMATION AVAILABLE ON OR THROUGH IT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND. WE DO NOT PROMISE OR GUARANTEE ANY PARTICULAR RESULT FROM USING THE SITE, AND WE DO NOT GUARANTEE ANY TREATMENT OUTCOME. CONTENT MAY BE INACCURATE, INCOMPLETE, OR OUT OF DATE.

TO THE FULLEST EXTENT PERMITTED BY LAW, ENGAGE WELLNESS, ITS LICENSORS, AND ITS SUPPLIERS DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE ARE NOT RESPONSIBLE FOR: (A) ERRORS, MISTAKES, OR INACCURACIES IN CONTENT; (B) PERSONAL INJURY OR PROPERTY DAMAGE OF ANY KIND RESULTING FROM YOUR ACCESS TO OR USE OF THE SITE; (C) UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS OR ANY INFORMATION STORED ON THEM; (D) ANY INTERRUPTION OR STOPPAGE OF THE SITE; (E) VIRUSES, MALWARE, OR SIMILAR CODE TRANSMITTED THROUGH THE SITE BY ANY THIRD PARTY; OR (F) ANY LOSS OR DAMAGE RESULTING FROM THE USE OF ANY CONTENT POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE THROUGH THE SITE.

Information sent to or from the Site travels over networks beyond our control, and we are not liable for any delay, failure, interruption, or corruption of data in transit. Some states do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

16. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL ENGAGE WELLNESS OR ITS OWNERS, MANAGERS, OFFICERS, DIRECTORS, EMPLOYEES, CLINICIANS, MEDICAL PROVIDERS, CONTRIBUTORS, AFFILIATES, AGENTS, OR CONTRACTORS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, ARISING FROM OR RELATED TO YOUR USE OF THE SITE, ANY SUBMISSIONS, OR ANY CONTENT, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

NOTWITHSTANDING ANYTHING TO THE CONTRARY IN THE AGREEMENT, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM RELATED TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100.00). Some states do not allow the limitation or exclusion of incidental or consequential damages, so these limits may not apply to you; in those states, our liability is limited to the fullest extent permitted by law.

17. Indemnification

You agree to defend, indemnify, and hold harmless Engage Wellness and its parents, subsidiaries, affiliates, licensors, and contractors, and each of their owners, members, managers, officers, directors, employees, clinicians, agents, and partners (the “Indemnified Parties”), from and against any claims, losses, liabilities, damages, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to: (a) your use of the Site or its Content; (b) your Submissions; (c) your violation of the Agreement; or (d) your violation of any law or the rights of any third party. We may assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense.

18. Term and Survival

The Agreement remains in effect for as long as you use the Site. Any provision that by its nature should continue after the Agreement ends will survive, including Sections 8, 9, and 12 through 19.

19. Miscellaneous

  • Entire agreement. The Agreement, including our Privacy Policy, is the entire agreement between you and Engage Wellness regarding the Site and supersedes any prior understandings on that subject.
  • Relationship of the parties. Nothing in the Agreement creates any agency, partnership, joint venture, employment, or franchise relationship between you and us.
  • No third-party beneficiaries. The Agreement is between you and Engage Wellness only, and no other person has any rights under it.
  • Headings. Section headings are for convenience only and have no legal effect.
  • No waiver. Our failure to enforce any right or provision of the Agreement is not a waiver of that right or provision.
  • Severability. If any provision of the Agreement is found unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will stay in full effect.
  • Assignment. You may not assign or transfer your rights under the Agreement. We may assign our rights without restriction.
  • Modifications. No written or oral modification of the Agreement is binding on us unless it is in writing and signed by an authorized officer of Engage Wellness, except for updates we post to this page under Section 4.
